Your son become eligible for NRI quota only when he took atleast 2 year of education in a foreign country, inclusive of 11th and 12th(not beyond) during the last 8 years.
If your son is with your brother and taking education there then you can easily apply for NRI quota. You have to visit DASA website for more details.
